Booking Process
Initially, you should first contact us with the dates that you require. Once we have confirmed the availability of these dates and the cost, we will provisionally book it, and ask you to read and agree to, our standard Terms and Conditions, and to complete a booking form which we will send to you. Once fully completed and signed, you should then return it, together with your deposit cheque, to the address specified. A provisional booking will be held for seven days pending receipt of a completed booking form together with full deposit or full payment, as appropriate. The balance (plus the refundable security deposit) is payable 8 weeks before your arrival at the villa. If you book less than 8 weeks before your trip, then the full amount is payable immediately upon booking. Arrival information will then be sent to you 2 weeks before your arrival at the villa.

Provisional Booking
A provisional booking will be held for seven days only, pending receipt of a completed booking form together with either the full deposit or full payment, as appropriate. A booking will only be considered firm when the booking form and appropriate deposit has been received.

Booking Form
All guests must be identified on the booking form. Only persons named on the booking form are allowed to stay in the villa. Florida State Law prohibits subletting, sharing or assigning. Any person not shown on the booking form will be asked to leave. On receipt of the completed booking form and appropriate deposit we will confirm the booking in writing (and by E-mail if applicable). The completed booking form must be signed and returned with either a deposit of £50.00 per week (or part thereof) or the full rental amount. Booking Deposit
A deposit of £50.00 per week (or part thereof) is required with the booking form, to secure a booking.

Final/Balance Payment
The final balance is payable 8 weeks before the date of arrival at the villa. Where booking instructions are received within 8 weeks of arrival, the full rental fee is payable at the time of booking.

Security Deposit
A refundable security deposit of £150.00 is required and must accompany your final balance. This will be refunded in full not later than 1 calendar month following the end of your rental, upon receipt of a satisfactory management report that there has been no loss or damage to the villa. The booking form signatory will be liable for all costs resulting from this inspection other than any costs arising from acceptable wear and tear. The signing of the booking form confirms your acceptance to pay for any damage of any kind caused by your occupancy of the property. The cost of repairs and/or replacements will be deducted from your security deposit. . In the event the security deposit is insufficient to cover breakages, damages, or additional cleaning or excessive use of electricity (caused for example, by leaving external doors open with the air conditioning on) the Client will be liable for the additional costs. Failure to return the key to the lock box when you leave the property at the end of your stay will incur a replacement fee of $50. Do not change or attempt to change the code on the lock box.

Payments/Reimbursements
At present, only payments by cheque are accepted. All received payments (including security deposits) will be immediately paid into our client account, and any reimbursements (such as security deposits) will be paid from this account. No post-dated cheques will be accepted.

Cancellation by Client
Once your booking has been confirmed, you may cancel the booking at any time subject to the clauses detailed below. The cancellation must be in writing, and the following cancellation charges apply to all rentals:-
More than 8 weeks before arrival, deposit forfeited (unless rebooking within 6 months)
Between 4 and 8 weeks before arrival, 50% of total cost forfeited
Less than 4 weeks before arrival, 100% of total cost forfeited
It is the responsibility of the signatory to ensure that the signed cancellation letter reaches the owner. Verbal, faxed or E-mail cancellations are not acceptable. If the owner is successful in re letting the property for all or part of the reservation period, the full balance or part thereof, the total cost will be refunded. The security deposit is not subject to any cancellation charges and would be refunded in full.

Cancellation by Owner
The owners reserve the right to cancel the booking if the final/balance payment has not been received in full, and in accordance with the conditions set out in the booking procedure and these Terms and Conditions. The owners reserve the right to cancel any bookings providing written notice is given and any balance paid refunded. In the unlikely event that circumstances beyond our control necessitate cancellation of the booking, we will refund any monies paid to the party leader. Any and all refunds will be made without interest, compensation or consequential loss of any kind.

Rental Period
The villa will be available to guests as of 4pm local time on the day of arrival and terminates at 11am (prompt) on the day of departure, by which time the villa must be vacated. Any individual variations to these normal times must be agreed in advance and may incur an additional charge. Early arrival and late departure is not possible unless previously agreed. Failure to comply may result in additional charges of £50/$80 per hour and you will be asked to leave the villa immediately. The minimum rental period is 7 days.

Accommodation
The property may only be occupied by two people per bedroom, up to a maximum of eight people. The villa is provided only for the guests as detailed on the booking form at the time of booking. An additional charge of £50/$80 may be made per additional person per night when the number of people occupying the house does not agree with the booking form. An adult must accompany guests under the age of 21.

Owner and Management Company Access
The owners, or agents of our Management Company, shall be allowed access at any reasonable time during your stay, in order to perform routine maintenance or repairs.

Responsibilities and Villa Care
The client and all persons stated on the booking form are responsible for the care of the property during the rental period and are expected to take reasonable care of it including the locking of all doors, topping up of pool water (as required) and ensuring the security alarm is activated whenever the property in unoccupied. At the end of the rental period, all utensils, carpets, furnishings, walls, fittings must be left clean and tidy, and in a reasonable condition for the cleaners. It is the guest’s responsibility to notify the management company immediately of any sudden equipment failure so that reasonable action can be take to rectify the situation.

Smoking
For the comfort and safety of all our guests, smoking is not permitted within the property at any time.

Animals and Pets
No animals or pets are permitted in the villa at any time.

Safety
Smoke alarms are provided for your safety and must not be tampered with in any way. It is the Client’s responsibility to promptly report any malfunction of this equipment to the Management Company. All persons use the pool and surrounding area entirely at their own risk. At all times children must be supervised by parents or other responsible adults when using the swimming pool.

Pool Heating
Pool heating is available as an optional extra (£100 per week, or part thereof) and is recommended if you intend to use the pool during the cooler winter months (October to May). We recommend that you request pool heating at the time of booking to ensure that the pool is heated when you arrive. However, pool heating can be arranged after arrival by contacting the Management Company, however it may take a day or so to be enabled. If the pool heater cannot reach optimum temperature due to adverse cold weather conditions the owners or the management company cannot accept liability.

Use of Swimming Pool and Spa
Do not allow children to use the facilities unsupervised or allow adults under the influence of alcohol or drugs to enter the water. We will not be liable for any loss or injury resulting from the use of the villa, pool or spa. No items of any description other than people or pool toys are to be placed in the pool and spa. For your own safety, glass, crockery and bottles are not allowed in the pool, spa or nearby vicinity. You will be liable for the full cost of any damage (including loss of rental income while any damage is repaired) if you do not adhere to the swimming pool and spa terms and conditions.

Complaints
Any complaints should be brought to the immediate attention of the Management Company, who will make every effort to resolve the problem. It is considered reasonable to allow the Management Company 48 hours to rectify most problems with the property.

Law
This conduct is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English Courts.

The Agreement
By signing the booking form the Client accepts these Terms and Conditions and warrants that he/she is authorised to agree them on behalf of all other persons named on the booking form, including those substituted or added by subsequent agreed amendment of the booking, and shall be binding on all persons stated on the booking form. Each booking will be confirmed by the owner, as soon as possible after receiving the booking form and deposit and only on receipt of this confirmation by you will the booking be treated as confirmed. Once the owners have confirmed the booking to you and you have paid a deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed. The remaining balance of the agreed rental cost must be paid eight weeks prior to your departure. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking. In these circumstances your reservation deposit will be forfeited. Neither ourselves, nor our Management Company will be liable for any costs you may incur, nor shall we pay any compensation, nor make any refunds due to this action.

Party Size
Everyone occupying the property must be listed on the booking form, including small children. This is Florida state law and must be adhered to. The accommodations cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. The property is fully licensed for short-term rentals in Florida. The owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.

Insurance
It is a condition of the booking that all members of the Party are covered by travel and medical insurance which carries adequate protection against delays and cancellations, and has adequate medical insurance for the USA, and also for your luggage and personal belongings for the duration of your stay, including travel both to and from the villa.

Code of Conduct
Oak Island Harbor is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of Oak Island Harbor. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbours after 10.30pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, or residents of Oak Island Harbor or damage to any property, the owners or there management company reserve the right to terminate your rental agreement immediately and forthwith.

Use of Utilities
Cable television and normal usage of gas, water and electricity is included in the rental price. You may be subject to the full costs of any additional charges for abuse of utilities, if for the period of your stay, bills are in excess of 15% of normal usage.

Liability
The owners and their agents accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused, while travelling to the property, staying in the property or after departure from the property. The use of all accommodations and amenities including the pool is entirely at the user’s own risk. Children must be supervised by responsible adults at all times when using the pool. The owners or their agents cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure. The owners and the management company cannot accept responsibility for the sudden failure of villa equipment but will take immediate and reasonable action to rectify any such failure upon notification by the guests. If the pool heater cannot reach optimum temperature due to adverse cold weather conditions the owners or the management company cannot accept liability. We accept no responsibility for and shall not be liable in respect of any loss or damage or alterations, delays or changes arising from circumstances outside our control such as war or threat of war, fire or adverse weather conditions, government action, technical problems with transport, closure or congestion at airports, cancellations or changes of schedules by airlines or theft from the villa premises, both interior and exterior including garage and pool area. In the unlikely event of us being negligent and/or in breach of our contract with you, our liability shall be limited to the total cost of your booking with us.

Force Majeure
As with any other holiday, there maybe circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of, or severe damage to the property. Such circumstances are referred to as Force Majeure. In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot, or if the alternative arrangements are not acceptable to you, then they will refund all monies paid. This will be the full extent of the owner’s liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, howsoever arising.

Accuracy of Information
A great deal of care has been taken to ensure the accuracy of the information we have provided. However, facilities and services may not be available or open, due to renovation/maintenance works, adverse weather etc. Where we are aware that a facility or service advertised in the information provided will not be available during the period of your rental, we will take steps, wherever possible, to notify you prior to travel. At times it may be necessary to replace items at the villa with similar items of an equivalent or better standard. Wherever possible, we will endeavour to notify you of such changes prior to travel. We reserve the right to reasonably amend any of the terms and conditions set out herewith.
